Following consultation
with the Leader and
Deputy Leader, to
determine any matter the
Council is required to
make a decision on under
Part 5 Chapter 3 (Assets
of Community Value) of
the Localism Act 2011
and the Assets of
Community Value
(England) Regulations
2012.

To undertake and
determine a review under
Section 92 of the
Localism Act 2011 of a
listing of an asset of
community value, where
the original decision was
made by another Director.

To undertake and
determine a review of a decision on compensation
in relation to a listing of an
asset of community value
under Reg 16 of the
Assets of Community
Value (England)
Regulations 2012, where
the original decision was
made by another Director.

Reasons for the decision:

To ensure the Community Right to Bid functions
can be carried out, following the SAMT restructure.

Alternative options considered:

The alternative of delegation these functions to the
Director of Development was rejected as the Directorate
includes the estates department and Council assets
may be nominated as assets of community value.
It is therefore appropriate for another Director to determine the listing nominations and hear reviews if necessary.
