Moved by Councillor Sandra Peake and seconded by Councillor Andrew Joesbury

RESOLVED that subject to the amendment to Councillor Dixon’s name appearing as Maxine Dixon, the Minutes of a General Licensing sub Committee held on 16th January 2020 be approved as a correct record.

The Local Government (Access to Information) Act 1985

To move:-

 

“That the public be excluded from the meeting during the discussion of the following items of business to avoid the disclosure to them of exempt information as defined in Paragraph 1, Part I of Schedule 12A to the Local Government Act 1972 (as amended by the Local Government (Access to Information) (Variation) Order 2006)”.

Moved by Councillor Ray Heffer and seconded by Councillor Andrew Joesbury

RESOLVED that the public be excluded from the meeting during the discussion of the following items of business to avoid the disclosure to them of exempt information as defined in Paragraph 1, Part I of Schedule 12A to the Local Government Act 1972 (as amended by the Local Government (Access to Information) (Variation) Order 2006).

To consider whether a HackneyCarriage/Private Hire Vehicle applicant is a fit and proper person to hold a licence with the Council. (MGE/20).

Minutes:

The Applicant attended the meeting for Committee to decide if he was a fit and proper person to hold a Hackney Carriage/Private Hire Vehicle Drivers licence.

 

The Licensing Team Leader presented the report.

 

The Hearing Procedure was followed.

 

The Applicant, the Licensing Team Leader, the Licensing and Enforcement Officer left the meeting whilst Committee deliberated and returned for the announcement of the decision.

 

Moved by Councillor Rose Bowler and seconded by Councillor Sandra Peake

RESOLVED that (1) the Applicant was a fit and proper person to hold a Hackney Carriage/Private Hire Vehicle Drivers licence,

 

            (2) the licence be granted to the Applicant.

To consider whether a Hackney Carriage/Private Hire Vehicle Driver is a fit and proper person to continue to hold a licence. (DEN/20)

Minutes:

The Licence Holder had requested in writing that his application be considered by Committee

 in his absence as he was unable to attend the hearing.

 

The Licensing Team Leader presented the report.

 

Moved by Councillor Rose Bowler and seconded by Councillor Mary Dooley

RESOLVED that the Licence Holder’s licence be REVOKED.

 

Having considered the email received from the Licence Holder and the evidence presented at the hearing, the Sub-Committee determined that the Licence Holder was not considered a ‘fit and proper person’ within the scope of the statutory provisions and there was no exceptional reason to depart from the Council’s Policy.
